A procedural order issued by a panel convened under the U.S.-Canada Softwood Lumber Agreement (SLA) to consider the merits of U.S. allegations that forest sector assistance programs in Ontario and Quebec violate the terms of the SLA appears to indicate that the United States has prevailed on some points in its challenge, sources said.

The "Buy American" provisions included in the $154 billion jobs bill passed by the House on Dec. 16, which are opposed by the Canadian federal government and a coalition of U.S. business groups, could be a troubling sign for the ongoing negotiations between the U.S. and Canada on almost identical provisions included in the U.S. economic stimulus package, sources this week speculated.

U.S. Department of Homeland Security Secretary Janet Napolitano and Canadian Public Safety Minister Peter Van Loan on Nov. 24 announced that they will resume work toward aligning each country's trusted shipper programs but a DHS spokeswoman said this week that no time line had yet been identified for aligning the programs.
